1. Acceptance of Terms
By accessing or using the Jamii AI API, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Jamii AI provides an AI-powered API-as-a-Service platform offering the following capabilities:
- Conversational AI chat
- Voice processing (speech-to-text, text-to-speech, audio conversations)
- Image recognition, analysis, and generation
- Document generation (Word, PowerPoint, PDF)
- Natural-language database querying with access control
- JWT-based authentication and authorisation
The Service is accessed via RESTful API endpoints and authenticated using JWT tokens.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your credentials and API tokens
- All activities that occur under your account
- Notifying us immediately of any unauthorised access or security breach
We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You shall not:
- Use the Service to generate, store, or transmit illegal, harmful, or offensive content
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service
- Circumvent authentication, access controls, or rate limits
- Use the Service to build a competing product or service
- Resell or redistribute API access without prior written consent
- Submit content that infringes on intellectual property rights
- Use the Service for automated scraping, spam, or denial-of-service attacks
- Introduce malware, viruses, or other harmful code
5. API Usage and Rate Limits
Your use of the API is subject to the rate limits and quotas associated with your subscription plan:
- Starter — 1,000 API calls per month
- Pro — 50,000 API calls per month
- Enterprise — Unlimited API calls
Exceeding your plan's limits may result in temporary throttling or suspension of service. We will notify you before taking action when possible.
6. Subscription and Billing
6.1 Pricing
Pricing is based on your selected subscription plan. Current pricing is published on our website and may be updated with 30 days' notice.
6.2 Payment
Subscriptions are billed monthly in advance. Payment is due on the billing date associated with your account. Failure to pay may result in service suspension.
6.3 Refunds
All subscription fees are non-refundable except where required by law. If you cancel mid-cycle, you retain access until the end of the current billing period.
6.4 Free Trials
Trial periods, when offered, are subject to the same Terms. We may require payment information to start a trial. You will be charged at the standard rate when the trial expires unless you cancel beforehand.
7. Intellectual Property
7.1 Our Property
The Service, including its software, documentation, API design, and branding, is owned by Jamii AI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.
7.2 Your Content
You retain ownership of the content you submit through the Service. By using the Service, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the Service.
7.3 Generated Content
Content generated by the Service (AI responses, generated images, documents) is provided for your use. You are responsible for ensuring that your use of generated content complies with applicable laws and third-party rights.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of data as described therein.
9. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or security reasons. Planned downtime will be communicated in advance when possible.
Uptime SLAs apply only to Pro and Enterprise plans as specified in your subscription agreement.
10. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind
- We do not guarantee the accuracy, completeness, or reliability of AI-generated content
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
11. Indemnification
You agree to indemnify and hold harmless Jamii AI, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
Either party may terminate these Terms at any time:
- By you — cancel your subscription through your account settings or by contacting support
- By us — we may suspend or terminate your access if you violate these Terms, with notice when practicable
Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination (liability, indemnification, intellectual property) will remain in effect.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Jamii AI operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
